Minimum Wage and Minimum Wage Regulation

April 12, 2012 - Please take notice that effective May 1, 2012, Yukon's minimum wage will increase to $10.30 as recommended by Yukon's Employment Standards Board. This brings Yukon's minimum wage rate to the second highest in Canada.

Authority for Review of Minimum Wage

• The Employment Standards Act sets minimum standards of employment in Yukon. It also establishes an Employment Standards Board which has five members who represent employers and employees.
• The Act provides the Employment Standards Board with the authority to review and establish the minimum wage rate in Yukon and it typically does so in discussion with the Yukon government, businesses, employers and employees.
• The Employment Standards Board has an arm’s-length relationship with the Yukon government, with members nominated from both employer and employee stakeholder groups.
• It is mandated to uphold the Employment Standards Act, which sets out the minimum terms and conditions of employment that must be adhered to by employers and employees.

Results of Last Minimum Wage Review (2005)

• The last review of Yukon’s minimum wage took place in 2005 when the Board established an increase (to $8.25/hr) and an annual inflationary factor based on the Consumer Price Index.  The rate has increased every year since 2005 and is currently set at $9.00 per hour as of April 1, 2011.
• The MW was $7.20 from Oct 1, 1998 to March 31, 2006, before it was increased to $8.25 effective April 1, 2006 as a result of the 2005 review.

Role of the Department of Community Services

• The department provides support to the Employment Standards Board by assisting with advertising and logistics, and similar type administrative functions.
• The department also funds the cost of the review from within the Employment Standards Branch budget.

Effect on employees of first nation governments / federal jurisdiction

• Yukon’s Employment Standards Act does not apply to employees of first nation governments or employees who fall under federal jurisdiction.
• Minimum wage rates for first nation government employees are set under the Canada Labour Code.
